Paul Ogunde joined Walker Kontos in 2007 from Njoroge Regeru & Co Advocates. He had prior to working with Njoroge Regeru & Co Advocates worked with Hamilton Harrison & Mathews since 2003 when he was admitted as an advocate.

Paul’s practice covers commercial litigation, intellectual property disputes, debt recovery and security realisation, insurance litigation, banking litigation, litigation surrounding receiverships, tax litigation, employment law, public procurement litigation as well public law litigation in the area of judicial review. Paul has also adviced on setting up of non profit entities and the regulatory environment they operate in. Recent transactions handled by Paul include :-

Litigation

  • Represented Kenya Commercial Bank Limited and Eastern and Southern African Trade and Development Bank in assorted Court proceedings to recover from Triton Petroleum Company Limited a sum of Kenya Shillings 3 Billion.

 

Employment

  • Successfully represented Mobile Telecommunication Company SPC Bahrain based in Manama and Celtel Kenya Limited in litigation with senior executive who sought to challenge the transfer of Zain Africa business and Assets to Bharti Airtel Limited of India on the back of claims of about 2 Million USD as terminal dues.

 

Debt Recovery/ Enforcement of Securities

  • Represented CFC Stanbic Bank Kenya Limited in the appointment of Receivers/Managers over Xerodoc Limited, the then exclusive Licencees for Xerox products in Kenya and advising the receivers on various issues including priority of claims by other creditors and complex retention of title claims. The receivership has resulted in substantial recovery of the debt. 
  • Represented several commercial banks including Barclays Bank, Kenya Commercial Bank, Paramount Universal Bank, Oriental Commercial Bank and CFC Stanbic Bank on both corporate and retail recoveries. Over the last year he has recovered of Kshs 250,000,000 for these clients. The cases have brought to fore close interrogation of security and transaction documentation.

 

Insurance

  • Represented Lion of Kenya, Mercantile Insurance and Real Insurance Company in various running down matters and arbitrations. He has successfully made full recovery in most of the cases that he has obtained judgment in favour of his clients.

 

Intellectual Property

  • Advising a pharmaceutical and medical systems distributor with reach across Africa in connection with claims that it has breached the trademark of a well known global brand.

 

Non profits

  • Advising Total R & M – Africa & Middle East and Total Kenya Limited on various legal aspects in the proposed road safety initiative in collaboration with the World Bank over the Northern Corridor transcending Kenya, Uganda & Rwanda and acted in setting up " Safe Way Right Way " an NGO that is executing the initiative.

 

Paul is also a long serving member of the Milimani Commercial Courts Working Committee where he has been an active member since December 2005. This committee comprises the Chief Magistrate of the Milimani Commercial Courts and all the senior Executive Officers of the High Court at Milimani and the Magistrates court and a few select advocates.
